Terms of Service

1. About Quizly

Quizly (“we”, “us”, “our”) is an educational platform available at quizly.com.au, operated by Get Renting Pty Ltd (ABN 35 690 434 603) trading as Quizly, in Australia. Quizly provides online practice materials to help children prepare for the NSW Opportunity Class Placement Test and to build skills in reading, mathematics, and thinking.

These Terms of Service (“Terms”) govern your access to and use of Quizly. By creating an account or using the service, you agree to be bound by these Terms. If you do not agree, do not use Quizly.

2. Who May Use Quizly

Quizly accounts may only be created by a parent or legal guardian (“Parent”) on behalf of their child. By registering, you confirm that:

• You are at least 18 years old.
• You are the parent or legal guardian of the child whose profile you create.
• You consent to your child using Quizly under your supervision.
• The information you provide is accurate and up to date.

3. Accounts and Security

Parent accounts are accessed via a one-time code sent to your registered email address. You are responsible for keeping your email account secure and for all activity that occurs under your Quizly account.

Child devices are linked using a temporary access code generated through your parent account. You are responsible for managing which devices have access to your child’s profile. You can revoke device access at any time through your account settings.

4. Free Trial

New subscribers receive a 7-day free trial when they first sign up. During the trial period you have full access to all Quizly features.

• Payment details required: A valid payment method must be provided at sign-up to start your free trial. You will not be charged during the 7-day trial period.
• Automatic conversion: If you do not cancel before the end of your 7-day trial, your subscription will automatically convert to a paid monthly plan and your payment method will be charged on day 8.
• Cancellation during trial: You may cancel at any time during the trial period through your account settings. If you cancel before day 8, you will not be charged and your access will end at the close of the trial period.
• One trial per person: The free trial is available once per person. Creating multiple accounts to obtain additional free trials is a breach of these Terms.

5. Subscriptions and Payments

After the free trial, Quizly is billed as a monthly subscription at $49 AUD per month.

• Billing: Payments are processed securely by Stripe. By subscribing, you authorise us to charge the payment method on file at the start of each monthly billing period.
• Cancellation: You may cancel your subscription at any time through your account settings. Cancellation stops your subscription from renewing at the next billing date. You retain access to Quizly until the end of the billing period you have already paid for.
• Change of mind: We do not offer refunds for change of mind part-way through a billing period. Accidental duplicate charges will always be refunded in full. This clause does not limit your rights under the Australian Consumer Law, including your right to a refund or other remedy if the service has a major failure or is not provided with due care and skill.
• Price changes: We will provide at least 30 days’ notice of any price increase by email to the registered parent account.

6. Family Pass

The Family Pass is a limited, one-time payment of A$1,999 that provides access to Quizly for a period of 3 years from the date of purchase. It is available to a limited number of early supporters.

• No recurring charges: The Family Pass is a single, non-recurring payment. No further amounts are charged for the 3-year access period.
• Non-transferable: The Family Pass is tied to the registered parent account and cannot be transferred to another person.
• 7-day money-back guarantee: You may request a full refund of your Family Pass purchase within 7 days of purchase for any reason. Request it directly from your parent portal billing tab — no email required. This aligns the Family Pass with the 7-day free trial available on monthly and annual plans.
• After 7 days: The Family Pass is non-refundable for change of mind. This does not limit your rights under the Australian Consumer Law, including your right to a remedy if the service has a major failure.
• Pro-rata refund if service stops: If during your 3-year period we permanently cease operating Quizly, remove the NSW Opportunity Class test preparation content that is the core purpose of the service, or make changes that render the service materially different from what was offered at purchase, you are entitled to a pro-rata refund of (A$1,999 ÷ 36) × remaining full months. Contact support@quizly.com.au within 60 days of the change to request this refund.
• Expiry: At the end of the 3-year period, continued access requires a current subscription at the prevailing rate.

7. Educational Content

Quizly’s questions and content are created for general educational and practice purposes. While we take care to ensure accuracy, we do not guarantee that any specific content is error-free or that using Quizly will result in any particular academic outcome, including placement in an Opportunity Class.

Quizly is a supplementary learning tool. It is not a substitute for formal schooling, tutoring, or official NSW Department of Education study materials.

8. Acceptable Use

You agree not to:

• Share, publish, or distribute Quizly’s questions, answers, or content without our written permission.
• Use automated tools, bots, or scripts to access or scrape Quizly.
• Attempt to circumvent test security measures or access answers through technical means.
• Use Quizly in a way that interferes with other users or the operation of the service.
• Impersonate another person or create multiple accounts to circumvent restrictions.

9. Intellectual Property

All content on Quizly — including questions, explanations, artwork, software, and design — is owned by us or our licensors and is protected by Australian and international copyright law.

We grant you a limited, non-exclusive, non-transferable licence to access and use Quizly for personal, non-commercial educational purposes only. This licence does not permit you to:

• Copy, reproduce, or redistribute content for commercial purposes.
• Create derivative works based on Quizly’s content.
• Share login credentials or device codes with users outside your immediate family (for this purpose, “immediate family” means your own children and other children living in your household under your care, including step-children and children in your legal guardianship; it does not include tutors, schools, other families, or extended family in separate households).

10. Suspension and Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or cause harm to other users or the service. We will attempt to provide notice before termination except where immediate action is required for security reasons.

You may close your account at any time through the account settings page. When you close your account, it enters a 30-day grace period during which you can restore it by signing in. After 30 days, all associated child profiles and data are permanently deleted. See our Privacy Policy for full details.

11. Availability and Changes

We aim to provide a reliable service but do not promise uninterrupted availability. We may temporarily suspend parts of Quizly for maintenance, security, or operational reasons. If we decide to permanently discontinue Quizly or materially change its core functionality, we will provide at least 60 days’ notice by email to the registered parent account and offer a pro-rata refund to all active subscribers and Family Pass holders for the remainder of the paid period.

We may update these Terms from time to time. We will notify you of material changes by email to the registered parent account at least 14 days before the changes take effect. Continued use of Quizly after changes take effect constitutes acceptance of the new Terms.

12. Disclaimer and Limitation of Liability

To the extent permitted by law, Quizly is provided “as is” and “as available”. However, this does not exclude, restrict or modify any rights or remedies you have under the Australian Consumer Law, including the consumer guarantees (such as the guarantee that services will be rendered with due care and skill and be fit for their specified purpose).

To the maximum extent permitted by law, our total liability to you for any claim arising from your use of Quizly shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) A$100. For Family Pass holders, (a) is calculated as A$1,999 ÷ 36 × the number of months of access already provided. Nothing in these Terms limits our liability for fraud, death or personal injury caused by our negligence, failure to comply with consumer guarantees under the Australian Consumer Law, or any other liability that cannot be excluded under Australian law.

13. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
